Eligibility
The [Expecting the Unexpected – Fight Animation Contest] (“Contest”) is open to legal residents of the fifty (50) United States and the District of Columbia who are at least thirteen (13) years old at the time of entry. Employees of Sponsor and other companies associated with the promotion of the Contest, and their respective parents, subsidiaries, affiliates and advertising and promotion agencies, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Contest is subject to federal, state, and local laws and regulations.
Agreement to Rules
By participating in this Contest, each entrant (and if a minor, such entrant’s parent or legal guardian) represents and warrants that such entrant meets the eligibility requirements in these Official Rules, and fully and unconditionally agrees to be bound by these Official Rules. In addition, each entrant agrees to accept the decisions of Sponsor, as final and binding. Winning a prize is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein. Sponsor reserves the right to refuse, withdraw, or disqualify any entry at any time at its sole discretion.
Contest Period
The Contest begins at [9:00am] Eastern Time on May 7, 2025, and ends at [11:59pm] Eastern Time on May 14, 2025 (“Contest Period”). The Contest Period may be extended at Sponsor’s sole discretion by public notice. Entries received outside of the Contest Period will be disqualified.
How to Enter
Entries can be submitted through the following methods:
(i) Online entry. Entries can be submitted online by leaving a comment with the name of the artist for the Expecting the Unexpected graphic novel on applicable Contest posts released during the Contest Period on Sponsor’s social media platform accounts, including [TikTok (@awa.studios); Instagram (@awastudiosofficial)]; Twitter (@AWA_Studios); YouTube Shorts (@AWAStudios). The commenting process for social media platforms (including whether an individual user account is required) are governed by their applicable terms of use.
(ii) Mailing a postcard or card (no smaller than 3½ x 5 inches and no larger than 4½ x 6 inches) with your complete name, mailing address, phone number and date of birth and proper postage to the following address: 178 Columbus Avenue #237194, New York, NY 10023. Write-in entries must contain all required fields and be received by Sponsor during the Contest Period.
The Odds of Winning are the Same Regardless of Method of Entry
Limit one (1) entry per person for the duration of the Contest Period, regardless of method of entry. All entries become the property of Sponsor and will not be acknowledged or returned. Entries received from any person in excess of the stated limitation will be void. Any attempt to obtain more than the stated number of entries by using multiple social media platform accounts, email addresses, identities, profiles, registrations and logins, or any other methods will void that person’s entries and that person may be disqualified. Use of any automated system to enter is prohibited and will result in disqualification. The “authorized account holder” of a social media platform account is the individual who is the authorized holder of the email address associated with such account (based upon information submitted at the time the account was created).
Neither Sponsor nor any affiliate is responsible for any entry that is lost, late, illegible, stolen, mutilated, incomplete, invalid, unintelligible, postage-due, misdirected or undeliverable, whether due to system errors, omissions, interruption, deletions, defects, delay in operations or transmissions, theft or destruction or failures, faulty transmissions or other telecommunications malfunctions, human error, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise. Only fully completed entries are eligible. Proof of submission will not be deemed to be proof of receipt by Sponsor.
Drawing
Approximately one week after the end of the Contest Period, Sponsor will select one (1) winner in a random drawing from among all eligible entries received. The odds of being selected depend on the number of entries received. Sponsor will attempt to notify the winner via direct message on the social media platform of entry, email or telephone.
In the event that a potential winner cannot be contacted, fails to claim the prize within one week after the date of the first attempted contract, fails to deliver an executed declaration and release to Sponsor within the specified timeframe, or the prize is returned as undeliverable, such potential winner forfeits the prize and an alternate winner may be selected from among all remaining eligible entries. Sponsor is not responsible for nor shall have any liability for a potential winner’s failure to receive notices due to email security settings that may cause notifications to be marked as spam or junk email, or provision of incorrect or otherwise non-functioning contact information. If a potential winner is a minor in his/her jurisdiction of residence, Sponsor reserves the right to award the prize in the name of his/her parent or legal guardian, who will be required to return a signed declaration and release on such potential winner’s behalf and fulfill any other requirements imposed on such potential winner set forth herein. Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The Prize will be fulfilled [approximately three weeks] after the conclusion of the Contest.
By accepting the Prize, the winner (or his/her parent or legal guardian if entrant is a minor) grants Sponsor and its designees the right to use such winner’s name, likeness, voice, statements and biographical information in connection with the Prize (as defined below) and for advertising, promotion and other marketing purposes related to the Contest in any and all media without additional compensation, permission or notification, including, without limitation, in a public announcement of the winner, except where prohibited by law.
Prize
The winner will be inserted into an animated fight sequence from Expecting the Unexpected based on art by Deodato created using www.viggle.ai (approx. retail value $[_50_]) (the “Prize”).
General Conditions
In the event that the operation, security or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Contest is unable to run as planned for any other reason, as determined by Sponsor in its sole discretion, Sponsor may, in its sole discretion, either (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules or (b) terminate the Contest and, in the event of termination, award the Prize at random from among the eligible, non-suspect entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages (including attorney’s fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision.
Third-Party Services
The Contest may link to, integrate with, or incorporate third-party content, sites, services, or platforms, including, without limitation, advertisers, online merchants, social media platforms and Viggle AI (collectively, “Third-Party”). Sponsor does not endorse and is not responsible for Third-Party Services, whether in terms of their correctness, accuracy, validity, propriety, reliability, legality, security, or otherwise, and Sponsor disclaims all liability in connection therewith. References to Third-Party Services do not imply endorsement of any Third-Party Services by Sponsor or any association with its operators. Any dealings with Third-Party Services are solely between you and the applicable Third-Party Services. Release and Limitations of Liability
By participating in the Contest, entrants agree to release and hold harmless Sponsor, its parents, subsidiaries, affiliates, advertising and promotion agencies, and other companies associated with the Contest, and each of their respective officers, directors, employees, shareholders, representatives and agents (the “Released Parties”), from and against any claim or cause of action arising out of, directly or indirectly, in whole or in part, from participation in the Contest or acceptance, receipt, use or misuse of the Prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Contest, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Contest; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) application downloads; (e) any other errors or problems in connection with the Contest, including, without limitation, errors that may occur in the administration of the Contest, the announcement of the winner, the cancellation or postponement of the Contest, the processing of entries or in any Contest-related materials; or (f) injury, death, losses or damages of any kind, to persons or property. Entrants further agree that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Contest, and in no event shall entrants be entitled to receive attorney’s fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by other entrants, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Entrants waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
Disputes
Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in New York. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants’ rights and obligations, or the rights and obligations of Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of New York, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than New York.
